2. Property Descriptions and Information
Details relating to specific property offers may be found on that items relevant web page. Please be advised that availability and details may change at any time and without notice.
If we are asked for advice with regards to any real estate offers such advice will be given to the best of our ability and in good faith but such advice is only given on the express condition that the Company is exempt from liability for failure in performance resulting directly or indirectly from such advice.
Clients are advised to make their own due dilligence checks on real estate offers prior to purchasing to ensure that they are satisfied before proceeding further.
3. Deposits and Cancellations of Sales
Uaproperty specialises in assisting English and overseas buyers to successfully buy and own property in Ukraine. We offer a fully managed buying process in which we handle all paperwork, translations and other actions related to a sale on behalf of a buyer.
Property documents and paperwork is verified by a competent professional prior to a sale concluding. The client does not hold Uaproperty or its parent company Property4Less Ltd liable for any errors or omissions.
When a sale commences, the client understands and agrees that the deposit paid for a property is non-refundable except in the event that the sale is cancelled by the vendor. Should a sale be cancelled by the vendor due to no fault of the purchaser, the client (purchaser) is entitled for a refund of their deposit less any bank fees.
Prior to any deposits or monies being paid towards real estate a client agrees to satisfy themselves in relation to due diligence checks.
The client agrees and accepts to conclude a sale by the given deadline upon which the aforemention reservation is due to terminate. The client understands that after the deadline has passed, as per Ukrainian law (the law of the country in which a property is being purchased), the vendor has the right to resell or cancel a sale and retain the deposits.
When making payments in relation to a real estate purchase, the client accepts to ensure that the full funds (i.e. clear balance) are received by the beneficiary and that all bank fees are covered. Failure to do this may result in the sale being delayed as we await for the shortfall to be covered by the client.
4. Listing Real Estate for Sale With Us
Should a client wish to list real estate in Ukraine with us, they are required to provide us with property documentation that is up to date and correct. This includes an up to date governmental valuation of the property.
If they are unable to provide this, under certain circumstances we may offer to organise this on behalf of the client. There will be a fee involved to cover time and expenses and this will vary depending on the property and its location.
We require that real estate listed with us is listed via the legal owner of the property and that we have contact with them.
We reserve the right to not list an offer for sale.
If any part of our terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
6. Data Protection Act 1998
Uaproperty takes the security and privacy of those of its clients and contacts about whom it holds personal information extremely seriously. The company follows strict security procedures in the storage and disclosure of personal information given to us in order to prevent unauthorised access.
Personal Data is held on our contact database either because of work we have undertaken or are currently engaged in, or because our clients have indicated that they would be interested in receiving material from us about our business and services. To that end we hold client contact details and the history of our client relationship. This allows us to manage our client relationships effectively and target items of interest so that clients do not receive unwanted material or messages.
In accordance with their rights under the Act, clients may request the amendment of the personal information held and to cease receiving direct marketing materials.
Uaproperty does not sell, rent or otherwise deal in the personal information we hold with third parties.
